1. Acceptance of Terms
By registering or using VendPopups.com, you confirm you are at least 18 years old and agree to these Terms and our Privacy Policy. If you don’t agree, please do not use the platform.
2. Platform Purpose
Vend Solutions LLC connects vendors and organizers for pop-up events. We act solely as a technology platform and are not a party to any agreements or transactions between users.
3. User Accounts
- Registration: Users must provide accurate, up-to-date information.
- Security: You are responsible for protecting your account credentials.
- Use: Accounts are for personal/business use only and may not be transferred.
4. Event Listings and Applications
- Organizer Responsibility: Organizers are fully responsible for the accuracy and legality of their events.
- Vendor Due Diligence: Vendors are expected to review event and organizer details carefully before applying.
- Approval: Organizers decide who to accept.
5. Payments and Fees
- Processing: Payments are handled via our third-party payment provider.
- Organizer Payouts: Funds are available for withdrawal 3 business days after the event ends.
- Fees: Platform fees and payment processing fees are non-refundable.
6. Cancellations and Fraud
- Organizer Cancellations: Vendors will receive a full refund (minus non-refundable fees) if the organizer cancels.
- Vendor Cancellations: Check the cancellation terms for each event.
- Fraudulent Events: If multiple vendors report an event as fraudulent within 3 business days, and it's deemed illegitimate upon review, full refunds (minus all fees) will be issued and the organizer will be permanently removed from VendPopups.
7. Data Storage and Privacy
To comply with tax reporting and payment regulations, we may collect personal information such as Social Security Numbers (SSN), Tax Identification Numbers (TIN), and bank account details. This data is securely stored and encrypted and maybe stored on secured third party platforms. We take data privacy seriously and follow industry-standard security measures—but no method of electronic storage is 100% secure. By using our services, you accept this risk.
8. Event Legitimacy Disclaimer
Vend Solutions LLC does not guarantee the accuracy, legality, or legitimacy of any event, organizer, or vendor listed on the platform.
While we strive to vet listings and investigate fraud reports seriously, users engage at their own risk. We are not liable for losses, damages, or disputes arising from participation in events listed on vendpopups.com.
9. Prohibited Use
You agree not to:
- Violate laws or regulations
- Post false or misleading information
- Impersonate others or misuse accounts
- Engage in fraudulent, harmful, or abusive conduct
- Interfere with the platform’s function or security
10. Intellectual Property
All platform content is the property of VendPopups (Vend Solutions LLC) or our licensors. Reproduction or misuse without permission is prohibited.
11. Limitation of Liability
Vend Solutions LLC is not liable for any indirect, incidental, or consequential damages resulting from your use of our platform or reliance on event listings.
12. Indemnification
You agree to defend and indemnify Vend Solutions LLC against any claims, liabilities, or expenses related to your use of the platform or violation of these Terms.
13. Termination
We may suspend or terminate your access at any time for violations of these Terms or misuse of the platform.
14. Changes to Terms
We may update these Terms at any time. Continued use of Vend Solutions LLC after updates constitutes acceptance of the revised terms.
15. Governing Law
These Terms are governed by the laws of the State of New Hampshire, USA.
